Terms and Conditions KaiwaDB

1. General

These Terms and Conditions (“Terms”) govern your use of the KaiwaDB service (“KaiwaDB”), provided by DEEP VISION s.r.o., a company established under the laws of the Czech Republic and operating within the EU.
By signing up or using KaiwaDB, you agree to be bound by these Terms.

2. Service Description

KaiwaDB generates database queries (Q) based on textual prompts and available schema metadata.
KaiwaDB never executes any generated query on your behalf. The execution of any query is always under the full control and responsibility of the user.
You are solely responsible for reviewing, validating, and executing any output generated by KaiwaDB.

3. Data and Privacy

KaiwaDB processes only structural metadata (e.g. table names, column names).
We do not access, store or process any real user or customer data from your databases.
All data processing is conducted in accordance with GDPR and applicable EU legislation.

4. Pricing and Payment

By using KaiwaDB, you agree to the pricing plan selected at the time of registration or purchase.
You are required to fulfill payment obligations according to the selected plan (monthly or annual).
Any changes in pricing will be communicated in advance and will not affect your current billing period.

5. Limitation of Liability

KaiwaDB is provided “as-is” during the beta period and may be subject to changes and updates.
We are not liable for any damage, loss, or consequences arising from the use of generated queries or integrations with your systems.
You acknowledge that KaiwaDB is an assistive tool and does not replace professional judgment or manual validation.

6. Beta Disclaimer

KaiwaDB is currently in public beta.
You may encounter occasional bugs or incomplete features.
We appreciate your feedback to improve the product and ensure stability before a full release.

7. Termination

You may cancel your use of KaiwaDB at any time.
We reserve the right to suspend or terminate your access in case of violation of these Terms.

8. Governing Law

These Terms are governed by the laws of the Czech Republic and applicable EU regulations.
Any disputes will be resolved by the competent courts in the Czech Republic.

9. Acceptable Use

You agree to use KaiwaDB only in accordance with applicable laws and ethical standards.
It is strictly prohibited to use KaiwaDB to:

• Generate content intended to harm, mislead, exploit, or defraud other individuals or organizations.
• Create or distribute malicious, discriminatory, hateful, or otherwise harmful queries or instructions.
• Intentionally produce database queries that could result in data corruption, deletion, or unauthorized access.

Any attempt to abuse KaiwaDB in a way that causes damage or legal harm to other parties will result in immediate suspension of access and may lead to legal action.
